All materials published on SKI BUMS (including, but not limited to, reviews, news articles,
photographs, images, illustrations, audio clips and video clips, also known as "Content")
are protected by copyright, and owned or controlled by SKI BUMS, Inc. or the party
credited as the provider of the content. You shall abide by all additional copyright notices,
information, or restrictions contained in any Content accessed through SKI BUMS and the
forums.
The forums and their Content (Posts) are protected by copyright as a collective work
and/or compilation, pursuant to U.S. copyright laws, international conventions, and other
copyright laws. You may not modify, publish, transmit, participate in the transfer or sale of,
reproduce (except as provided in this section of the Agreement), create derivative works
from, distribute, perform, display, or in any way exploit any of the Content (Posts) in whole
or in part.
You may download or copy SKI BUMS Content for personal use only (which permission
does not include permission to publish any SKI BUMS content on any commercial or private
website or in any print media), provided that you maintain all copyright and other notices in
such Content. You shall not store or publish any significant portion of any Content owned
by, or licensed to SKI BUMS, Inc., in any form. Copying or storing of any Content for other
than personal, non-published, noncommercial use is expressly prohibited without the prior
written permission from SKI BUMS, Inc.'s Owner and Publisher, and the copyright holder
identified in the individual Content's copyright notice.
Registration
As part of the registration process, you will select a password and User Name. You may not
(i) select or use a User Name of another person with the intent to impersonate that person;
(ii) use a name subject to the rights of any person other than yourself without
authorization; or (iii) register a User Name that SKI BUMS, Inc., in its sole discretion,
deems offensive or inappropriate. You will only be identified on the forums by this User
Name. It is up to you whether you wish to reveal your real identity or any other personal
information in a post or profile.
SKI BUMS, Inc. will not knowingly approve more than one subscriber account per member.
If at any time SKI BUMS, Inc. discovers or suspects one person holds more than one active
account, SKI BUMS, Inc. may, at its sole discretion and without prior warning, cancel any
and all accounts held by that person.
You shall notify webmaster@ski-bums.org of any known or suspected unauthorized use of
your account, or any known or suspected breach of security, including loss, theft, or
unauthorized disclosure of your password. You shall be responsible for maintaining the
confidentiality of your password.
You must be 18 years or older to use the SKI BUMS forum. You are responsible and held
accountable for all usage or activity on your account, including use of the account by any
third party using your account with or without your permission.
Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of
your account at SKI BUMS, Inc.'s sole discretion, and information about you may be
provided to appropriate law enforcement agencies.
SKI BUMS, Inc. reserves the right to send electronic mail to any and all subscribers for the
purpose of providing them with information deemed by SKI BUMS, Inc. to inform them of
changes, updates or alterations to SKI BUMS, Inc. and its forum.
The Small Print
You represent, warrant, and covenant that no materials of any kind submitted through your
account will knowingly (i) violate, plagiarize, or infringe upon the rights of any third party,
including copyright, trademark, privacy or other personal or proprietary rights; or (ii)
contain libelous or otherwise unlawful material. You hereby indemnify, defend and hold SKI
BUMS Inc., and all officers, directors, owners, agents, information providers, affiliates,
licensors and licensees (collectively, the "Indemnified Parties") harmless from and against
any and all liability and costs incurred by the Indemnified Parties in connection with any
claim arising out of any breach by you or anyone using your account of the Subscriber
Agreement or the foregoing representations, warranties and covenants, including, without
limitation, reasonable attorneys' fees. You agree you shall cooperate as fully as reasonably
required in the defense of any claim. SKI BUMS, Inc. reserves the right, at its own
expense, to assume the exclusive defense and control of any matter otherwise subject to
indemnification by you.
SKI BUMS, Inc. does not represent or endorse the accuracy or reliability of any advice,
opinion, statement, or other information displayed, uploaded, or distributed through the
Forum by any subscriber, information provider or any other person or entity. You hereby
acknowledge that any reliance upon any such opinion, advice, statement, or information
shall be at your sole risk. SKI BUMS, Inc. reserves the right, in its sole discretion, to
correct any errors or omissions in any portion of the forum. The SKI BUMS Forum is
published on an "as-is" basis without warranties of any kind, either express or implied,
including, without limitation, warranties of title or implied warranties of merchantability or
fitness for a particular purpose. You hereby acknowledge that use of SKI BUMS is at your
sole risk.
SKI BUMS contains links to other related Internet sites, resources, and sponsors of SKI
BUMS. Since SKI BUMS, Inc. is not responsible for the availability of these outside
resources, or their contents, you should direct any concerns regarding any external link to
its site administrator or Webmaster.
Examples of Common Subscriber Agreement Violations
1. Posting any message or image which is libelous, defamatory, obscene, pornographic,
abusive, or otherwise violates any law is not allowed. Also, posting any message which
encourages illegal activity is not allowed.
2. SKI BUMS, Inc. respects Copyright laws. Posting any message which includes more than
a link (if available) and a very brief quote from articles from other sources or web sites is
not allowed. Posting an entire article from other sources or web sites, or a substantial
quote therefrom, is in violation of Copyright laws, and all such posts will be removed from
the forums.
3. Posting any message which includes audio or javascript files is not allowed. All such
features are restricted for the exclusive use of the SKI BUMS, Inc. administrators, and all
such posts not posted by the administrators will be removed.
4. Repeatedly posting off-topic messages or otherwise deliberately disrupting our forums is
unacceptable behavior that may result in you losing all forum privileges without warning or
advance notice.
5. The message board is intended to be a forum for members to connect with one another
outside of our scheduled trips and events; it is not a place to make complaints or air
concerns. Please email us directly at info@ski-bums.org with any complaints or concerns
you may have. Postings on the message board that are not appropriate in this regard will
be removed and the author will be contacted directly about his/her concern.
We reserve the right to prohibit users who, in our sole judgment, in any way
violate acceptable forum behavior from participating in our discussions.
